These terms and conditions are governed by and construed in accordance with the laws of Indonesia, and any disputes will be subject to the exclusive jurisdiction of the courts of Indonesia.
Booking & Payment T&C
1. Booking and Payment
- Reservation Confirmation: A booking is confirmed only after receiving a non-refundable deposit of 30% of the total tour cost. Full payment is required 30 days before the tour departure date.
- Payment Methods: We accept payments via credit card, bank transfer, or Paypal. All payments must be made in USD or IDR.
- Late Payments: If full payment is not received by the due date, Asana Tour reserves the right to cancel the booking and retain the deposit. However, we will make every effort to contact you and offer alternative payment arrangements.
2. Cancellation and Refund Policy
- Customer Cancellations: Cancellations made 30 days before the tour departure date will receive a 100% refund of the total tour cost. No refunds will be issued for cancellations made within 30 days of departure.
- Agency Cancellations: Asana Tour reserves the right to cancel tours due to unforeseen circumstances (e.g., natural disasters, safety concerns). In such cases, customers will receive a full refund or the option to reschedule at no additional cost.
- Non-Refundable Services: Certain services, such as accommodation, activities or special event tickets, may be non-refundable. These will be clearly indicated at the time of booking, and we will work with you to minimize any losses.
3. Itinerary Changes
- Customer-Initiated Changes: Any changes requested by the customer after booking may incur additional fees and are subject to availability. We strive to accommodate your requests whenever possible.
- Agency-Initiated Changes: Asana Tour reserves the right to alter the itinerary due to circumstances beyond our control, such as weather conditions or safety concerns. In such cases, we will make every effort to provide a comparable or upgraded alternative.
4. Travel Insurance
- Requirement: All customers are required to purchase travel insurance that covers trip cancellation, medical expenses, and personal liability.
- Liability: Asana Tour is not liable for any costs incurred due to a customer’s failure to obtain adequate travel insurance. We recommend comprehensive coverage for peace of mind.
5. Liability and Responsibility
- Personal Safety: Customers participate in tours at their own risk. Asana Tour is not responsible for accidents, injuries, or illnesses that may occur during the tour, but we will provide full assistance in emergencies.
- Third-Party Services: Asana Tour acts as an agent for third-party providers (e.g., airlines, hotels, activities companies). While we carefully select our partners, we are not responsible for the performance or quality of services provided by these third parties.
- Force Majeure: Asana Tour is not liable for any losses, damages, or disruptions caused by events beyond our control, such as natural disasters, strikes, or political unrest. We will do our best to offer alternative arrangements.
6. Customer Conduct
- Behavioral Expectations: Customers are expected to conduct themselves in a manner that is respectful to other participants, local customs, and the environment. Asana Tour reserves the right to remove any customer who behaves in a disruptive or dangerous manner, without a refund.
- Compliance with Laws: Customers must adhere to local laws and regulations while on tour. Any legal consequences arising from a customer’s actions are the sole responsibility of the customer.
7. Privacy and Data Protection
- Data Collection: Asana Tour collects personal information necessary for booking and providing services. This data will be used in accordance with our Privacy Policy, ensuring your information is kept secure and confidential.
- Third-Party Sharing: Personal data may be shared with third-party providers (e.g., airlines, hotels) as required to fulfill bookings. We only partner with reputable providers to ensure your data is protected.
8. Dispute Resolution
- Governing Law: These terms and conditions are governed by the laws of Indonesia.
- Arbitration: Any disputes arising from these terms and conditions will be resolved through arbitration in Bali, in accordance with the rules of the Indonesian National Arbitration Board (BANI).
9. Acceptance of Terms
- Agreement: By booking a tour with Asana Tour, the customer agrees to these terms and conditions. It is the customer’s responsibility to read and understand these terms before booking.
